Terms of Service
1. Scope of Application
These Terms of Service apply to all consulting services and software access (SaaS) provided by Finest Selection Group GmbH (FN 649527m) and Finestselection e.U. (FN 567435p). Deviating conditions of the client are only valid if we have expressly agreed to them in writing. Our general terms and conditions according to the Austrian Professional Association UBIT (version Nov 2025) apply supplementarily.
2. Platform Access & SaaS
For access to our digital platforms (TCC, TP Automator, RCM, RaD Navigator), clients are granted a non-exclusive, non-transferable right to use the software for internal business purposes during the contract term.
3. Confidentiality
We commit to absolute confidentiality regarding all business and trade secrets of the client. This obligation remains in effect indefinitely even after the termination of the contract. The AI models utilized via our platform operate under a strict zero-retention policy and are not trained on client data.
4. Limitation of Liability
We shall be liable for damages — with the exception of personal injury — only in cases of gross negligence or willful intent. Claims for damages must be asserted in court within six months of gaining knowledge of the damage and the damaging party. The statutory warranty period is six months, unless mandatory law provides otherwise.
5. Intellectual Property
All copyrights and other intellectual property rights to work products created by the consultant remain with the consultant. The client receives a non-exclusive right to use the deliverables exclusively for the purposes defined in the respective contract.
6. Applicable Law
Austrian law applies exclusively. The place of jurisdiction is Vienna, Austria. Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
